The information that the public is worried about and needs to obtain is also the fear that some enterprises and local governments are open to the public. In the revision of the "Environmental Protection Law", everyone agreed that the implementation of the environmental protection legal system has a great relationship with the local government's interference. Local governments are eager to go to projects, and high-risk, high-energy projects often have high returns. If the value orientation of local governments is biased towards economic benefits, public health and environmental safety are all placed in a secondary position. At this time, information about new projects that are harmful to the environment and public health and may be controversial will certainly not be made public. According to the Dongguan EIA professional, it is a ridiculous explanation for officials not to disclose this information because 'the information belongs to state secrets because it involves social public interest'. The significance of public participation in the EIA is to make the EIA process a process of interest game, so that all parties can form a balanced situation and let the evaluation be carried out on a scientific basis. In the process of construction of major environmental impact projects, it is normal to have objections. The key is whether the benefits outweigh the disadvantages or the disadvantages outweigh the benefits. Whether the risks are within the controllable and acceptable range, is there enough measures to eliminate the hidden dangers?
According to the regulations, during the first public announcement period of the EIA, public consultation will be conducted on the proposed project by means of issuing questionnaires. For the way of sending questionnaires, this is the easiest way to be manipulated by humans, because the questions in the questionnaire can be designed to be ambiguous, and the answer chosen by people is yes. The representativeness and coverage of the surveyed public in the questionnaire survey are very limited. The premise of public participation in the survey should be to inform the public of all the information, the public can judge. In other words, information on construction projects and environmental impacts should be made public. However, does the EIA have this information and dare to disclose it? In what way should it be disclosed? During the period of approval of the EIA report, the public can make requests for relevant information, but there is little information available.
Internationally, from the beginning of the project, the public has opportunities to participate. The project side will proactively communicate with the stakeholders involved to get the information available to everyone as much as possible. If the public believes that the required information is not available, you can apply to the court for disclosure. At least one hearing will be held to give the parties an opportunity to fully express their opinions. This process is itself a process of information disclosure, and the public can have a fuller understanding of the project. These are things we don't have, and it's difficult to collect opinions effectively in the current way. The result can only be that the project often finds problems after the project starts, is completed or even polluted, and the opposing opinions are taken seriously.
